Marilize and Carla Aesthetics (Pty) Ltd, trading as MC Aesthetics, respects your privacy and processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African law.
2. Information we collect
We may collect identity and contact details, appointment and transaction information, treatment history, health information relevant to treatment safety, consent records, correspondence, website usage data, photographs where separately authorised, and information required by law.
3. Why we process information
We process information to respond to enquiries; book and administer appointments; assess treatment suitability; obtain informed consent; provide treatment and aftercare; keep clinical, financial and legal records; process payments and vouchers; protect clients and staff; manage complaints; improve our services; and send marketing only where lawfully permitted.
4. Lawful grounds and health information
Processing is based on consent, performance of an agreement, legal obligations, legitimate interests, and the protection of your or another person’s legitimate interests, as applicable. Health and treatment information is restricted to authorised personnel and practitioners who reasonably require it.
5. Sharing information
We may share information with authorised staff, treating practitioners, booking or technology providers, payment and accounting providers, professional advisers, insurers, regulators or authorities where necessary and lawful. Independent practitioners are responsible for the clinical records they create and for their own professional processing obligations.
6. Security and retention
We use reasonable organisational and technical safeguards. Records are retained only for as long as required for treatment, legal, professional, tax, insurance and dispute-resolution purposes, after which they are securely deleted, destroyed or de-identified.
7. Your rights
You may ask whether we hold your information, request access or correction, object to certain processing, withdraw consent where consent is the basis, request deletion where legally permissible, or complain to the Information Regulator. Some records cannot be deleted where retention is required by law or legitimate clinical and legal needs.
8. Photography
Clinical and progress photographs may be taken where necessary and with appropriate consent. They are stored confidentially. Photographs will be used for marketing only with separate written consent. Marketing consent may be withdrawn at any time without affecting the lawfulness of earlier authorised use.
